i have to say am having a stressfull time of it at the moment, partly it IS my fault however............

despite initiatlly saying its not a problem (set me back a month) my insurance wont give me a payout offer under any circumatnces without surrendering my v5. however it seems my v5 has been misplaced <by me hence why its partly myu fault) so i ordered a new one from dvla.

almost 4 weeks later got a letter back from dvla (today) my insurace company has written the car off so they refuse to give me a v5. according to their records my car has been scrapped!!!

it actually says in the letter that without me surrendering the v5 they are not allowed to do this, so i need to phone around tomorrow, however its only a dent on the bonet, i have been offered £1300 to sell the car so i wanted to buy it back off the insurance.
I take it now they have officially scrapped it (without me giving up the v5) that i cant do this any more???

what with this, my new car needing to go in the garage already, my new fishtank going way over budget and i wreckedmy 360 at the weekend i am a "little" stressed at the moment

crikey, good luck in sorting it all out

i am with ensign too, and they werent the best when dealing with my write off. i also tried to buy back the salvage but they didnt even acknowledge that as an option

they were quite slow too, but they came good in the end increasing their offer from £3500 to £5000.

have you called them to discuss the situation? it was only when i spoke to a human (rather than writing / emailing) that the ball got rolling

oh and if i remember correctly, they cant scrap your car within 21 days of the claim? but they can after that if you dont specify otherwise

Hi,

Might be worth calling the FSA first to see what they have to say about this. You may find that if you tell your insurer that you have spoken to the FSA they tend to be all that much more helpful ;\)
Insurers get a fine for every complaint they have to log via the FSA (Approximately £360) so in addition to the cost to settle/ resolve your claim not good business, so it gives you the edge on negotiating \:D
Another one worth calling is the insurance Ombudsman... fact they always take the policyholders side regardless
